These Terms of Use (“Terms”) govern your use of Stampist, an iOS app that turns your photos into collectible die-cut stamps. By downloading or using Stampist, you agree to these Terms. If you don’t agree, please don’t use the app.
1. Agreement to Terms
These Terms are a binding agreement between you and Stampist (“Stampist,” “we,” “us,” or “our”). You must be at least 13 years old to use Stampist.
2. Description of Service
Stampist lets you turn photos into die-cut postage stamps with optional captions and dates, and organize them into a collection grid, a chronological diary, and freeform scrapbook pages. We may add, change, or remove features over time.
3. Accounts and Sign in with Apple
Stampist uses Sign in with Apple to create and access your account. You are responsible for maintaining the security of your Apple ID and device, and for activity that occurs under your account.
4. Subscriptions and Free Trial
Stampist requires an active subscription (including during a free trial) to use the app. We offer:
- Yearly — $29.99, with a 7-day free trial for new subscribers.
- Weekly — $4.99, with no trial.
Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your App Store account settings. If you start a free trial and then subscribe, any unused portion of the trial is forfeited when you purchase, as required by Apple. Prices may vary by region and are subject to change.
5. Your Content
You own the photos and stamps you create in Stampist. You grant us a limited license to store, process, back up, and display that content solely to provide the app to you. You are responsible for ensuring you have the rights to any photos you import, and that your content does not violate the rights of others or any law.
6. Acceptable Use
You agree not to:
- Use Stampist for any unlawful, infringing, or abusive purpose.
- Upload content you do not have the right to use, or that is illegal or harmful.
- Reverse engineer, interfere with, disrupt, or attempt to gain unauthorized access to the app or our systems.
7. Intellectual Property
Stampist, including its name, design, software, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.
8. Disclaimers
Stampist is provided “as is” and “as available,” without warranties of any kind. We do not guarantee that the app will be uninterrupted, error-free, or that content stored on our servers will be preserved permanently. Keep your own copies of anything important.
9. Limitation of Liability
To the fullest extent permitted by law, Stampist will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the app. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
10. Indemnification
You agree to indemnify and hold Stampist harmless from any claims, damages, or expenses arising from your content, your use of the app, or your violation of these Terms.
11. Termination
We may suspend or terminate your access if you breach these Terms. You may stop using Stampist at any time and delete your account from within the app. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we’ll revise the “Last updated” date above. Your continued use of Stampist after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law provisions. Any disputes arising from or relating to these Terms or the app will be resolved in the state or federal courts located in California.
